BREEDER & BUYER(S) AGREEMENT

​

TERMS AND CONDITIONS

 

Registration Type: All puppies are placed with "Limited Registration" with the option to obtain "Full Registration" at no additional cost once requirements are met and completed. Once verification has been sent to the breeder; Věčné štěstí will give Full Registration. Any breeding or studding of dog will violate this contract. 

a. Official Hips/Elbows submitted with passing scores with SV or OFA
b. DM testing completed
c. Passing of temperament test through AKC, GSDCA,WDA,USCA
d. Dogs also must have correct structure, full dentition, standing ears and no disqualifying breed faults.
e. Buyer understands that all requirements must be met before Limited Registration will be lifted. 

Registration Name: All puppies will be registered through AKC by the breeder. New buyer may pick a name for said puppy as long as it starts with the current Litter Letter and will have the Breeders Kennel name (Věčné štěstí) at the end. Buyer is welcome to give the puppy any given call name. 

 

​Microchip: All puppies will be chipped and enrolled with AKC ReUnite

 

Deposit: $500.00 non-refundable deposit is required; See Deposit contract.

Remaining Balance: Due in Full before said puppy leaves. If paying with a check; check must be sent and cleared the week before the puppy leaves the breeder.

 

Right of First Refusal & Placing Pup: In the event the buyer is unable to keep said puppy for any reason at any point in the puppy’s/dog's life; buyer is required to contact the breeder immediately to decide what the best option is for said pup. I will always take back any of my puppies and under NO circumstances will said puppy be taken to a rescue/shelter/lab or pet store.

Health Warranty: Failure to  provide appropriate vet care and quality diet will void this warranty. Buyer agrees to keep the breeder informed about health issues that may arise. All information regarding the health of said puppy is very important and valuable in the successfulness of our breeding program. 

a. All puppies are examined by our vet Wildcat Veterinary Clinic and will come with a puppy health cert. along with age appropriate vaccinations and regular deworming.  
b. All puppies must be seen by the buyer's vet within the first 72hrs of receiving said puppy. If Buyer decides not to keep said puppy within the 72hrs or the vet sends proof that said puppy is sick then a Full refund will be given at the puppies return to breeder.
c. This warranty excludes any treatable health issues that may arise during ground transportation.
d. Should the puppy die unexpectedly within one year of purchase a necropsy will be required at the buyers expense and a diagnosis of a life-threatening  genetic illness must be proven to be the cause of death of said puppy. Copies of the necropsy and any paperwork involved in determining cause of death must be mailed or emailed to the breeder within 3 days of the date of death of said puppy. The Breeder will replace said puppy with the first available puppy of the same quality.  If a necropsy is not done then this warranty is no longer valid and the puppy will not be replaced.
e. Breeder will provide a 26 month hip/elbow warranty on said puppy. Warranty expires after 26 months from DOB of the puppy.
f. Buyer is required to have x-rays taken by an OFA certified veterinarian and evaluated by either OFA or SV 

 

If it is determined that the dog received a failing score on either hips or elbows all documents and x-rays must be sent to the breeder within 3 days of receiving the results. If you chose to still keep said dog, proof of spay/neuter is required from the Veterinarian who performed the surgery. After proof has been received a replacement puppy will be sent at the buyers expense from the next available litter. 

 

g. Breeder will disclose all litters produced will be DM Clear or Carrier and will never breed or produce DM affected dogs.
h. If said dog/puppy were to become pregnant or bred before 24 months of age or without all of the requirements met to obtain Full Registration, then this contract and warranty becomes Null and Void!!

 

​Replacement/Refund: No Cash refunds will be given under any circumstances, other than column b. 72hr puppy return. Buyer will allow Breeder up to 10 business days to initiate a refund. Once the refund has been initiated the breeder is not responsible for any delays in the processing. 

 

​No Other Warranties: The breeder assumes no responsibility of any nature with the respect to performance, activity, training, demeanor or other propensities of the puppy once it has left the breeders property. There is no guarantee for ears, teeth, allergies, aesthetic issues, temperament or structure.

 

Breeder does not guarantee color, adult size, undescended testicles, retained teeth, eye color, breeding ability, drive or personality. Improper bite or dentition, coat, hernias, trachea, hypoglycemia, internal or external parasites, luxating patella, minor physical flaws, loose stools or diarrhea or any common puppy ailments.

 

No other warranties or guarantees, expressed or implied, are made by the Breeder with the exceptions expressly and specifically set forth herein.

BUYER’S OBLIGATIONS

 

1. Buyer agrees to provide proper care such as adequate housing, safe environment, proper nutrition, water and appropriate veterinary care throughout the life of said puppy.
2. Buyer agrees to reduce the risks of orthopedic and joint issues by maintaining optimum body condition to ensure said puppy is not over or underweight, receives daily low impact exercise until growth plates have closed and joints have fully developed.
3. Buyer agrees to have ongoing open communication with Breeder. This includes change of address, email, phone numbers as well as any issues or concerns that may arise in the puppies lifetime. Buyer also agrees to send updated photos on occasion or as often as they like (hopefully often, we love getting pictures) throughout the life of the dog/puppy.

​BREEDER’S OBLIGATIONS

​

1. Breeder will raise this litter in a clean and safe environment, proper nutrition (RedPaw) water, socialization, dewormed at 2, 4, 6, & 8 weeks of age, DHPA vaccine given by our vet, health check cert, microchipped and AKC Registration.
2. Breeder agrees to have continued open communication and offers lifetime support to said buyer.
3. Breeder will be responsible for the well being of said puppy for its entire life and remains to have the utmost importance to have Right of First Refusal at any time per this contract.

 

​I confirm that I agree to have read and have had a full explanation of all the details and meanings of this contract prior to the purchase of said puppy, and I completely understand its purpose and reason. I also confirm that I am buying this puppy for myself and not as an agent for a third party.
